Terms of Use
Clear terms for using our website and starting a conversation with our team.
1. About these terms
These Terms of Use govern access to the KR Digital Dynamics (Pty) Ltd corporate website and its enquiry and newsletter facilities. The website provides information about our company, services, industries, products and career opportunities.
Use the website lawfully and consistently with these terms. Where a form requires acceptance, review the linked terms before submitting it. If you do not accept the terms applicable to a submission, contact us by email to discuss your request.
Projects are agreed separately. A website enquiry is an invitation to discuss your needs. It does not by itself create a development, consulting, partnership or support contract.
2. Website information and engagements
Service descriptions outline our capabilities. Scope, deliverables, pricing, timelines, acceptance criteria, intellectual-property arrangements, support and service levels must be agreed in a separate written engagement.
Website content is general information. It is not a project quotation or a guarantee that a particular solution will meet your organisation’s requirements. We may update descriptions as our offerings develop, subject to any commitments in an existing agreement.
Separate product licences, subscription terms and privacy notices apply where you use a KR Digital Dynamics application. These website terms do not replace them.
3. Acceptable use
You may browse the website, share links, submit genuine enquiries, explore partnerships and review career opportunities. You must not:
- Attempt unauthorised access, bypass security controls or interfere with availability.
- Submit malware, unlawful or abusive material, impersonate another person or send spam.
- Use forms to harvest information, misrepresent your authority or disclose information you are not entitled to share.
- Copy, republish or exploit website material in a way that infringes intellectual-property rights.
We may restrict abusive requests or access where reasonably necessary to protect the website, investigate misuse or comply with law.
4. Enquiries and submitted information
Provide accurate contact details and enough information for us to understand your request. If acting for an organisation, ensure you are authorised to communicate on its behalf. Please limit information to what is necessary and avoid sensitive or confidential project materials in the general contact form.
Submitting a message authorises us to use it to assess and respond to your request in accordance with the Privacy Policy. It does not transfer ownership of your intellectual property or grant us unrelated commercial rights over your idea.
The general enquiry channel is not a secure project repository and does not create a confidentiality agreement. If your proposal requires confidentiality, contact us to arrange an appropriate agreement before sharing restricted material. An acknowledgement confirms receipt; it does not confirm acceptance of a project or guarantee a response deadline.
5. Intellectual property and brand assets
Website text, design, original artwork and software are owned by KR Digital Dynamics or used under appropriate rights, except where third-party ownership is identified. You may view material and retain reasonable copies for personal or internal business evaluation, subject to applicable law and any displayed notices.
Permission is required for broader reproduction or commercial use unless a licence or law permits it. Third-party names, trademarks and logos remain the property of their respective owners. Their display does not grant visitors a licence to use them or imply a certification, agency relationship or endorsement beyond any expressly stated relationship.
6. External links and third-party services
Links to clients, technology providers, social platforms and external products are offered for convenience. We do not control their content, availability or independent privacy practices. Review their terms before providing information or using their services.
Security verification and email services support this website’s operation. The Privacy Policy describes relevant information handling. A third-party outage may affect a form or communication.
7. Privacy and newsletter subscriptions
Our Privacy Policy explains the collection and handling of information sent through the website. Agreeing to website terms does not by itself provide consent for electronic direct marketing.
Newsletter subscription is optional. Use the subscription controls to give your choice and contact info@krdigitaldynamics.co.za to withdraw it. Where marketing emails are sent, use the unsubscribe method provided. Necessary enquiry or contractual communications may continue separately.
8. Career opportunities
Role descriptions are invitations to apply and are subject to the stated eligibility requirements. Submitting an application does not create an employment relationship or promise an interview or appointment. Recruitment decisions are subject to an appropriate assessment and applicable employment law.
An employment offer must be confirmed through an authorised written process. Send recruitment correspondence to recruitment@krdigitaldynamics.co.za. Do not send bank credentials or unnecessary identity documents through a general enquiry.
9. Availability and changes
We aim to keep the website useful and accurate, but access may be interrupted for maintenance, faults, provider outages or security incidents. The public website does not provide a contractual uptime or response-time commitment.
We may correct errors, update content or change website facilities. Changes do not remove rights or obligations already established under an applicable agreement or law. Contact us to confirm current information before relying on it for a significant commercial decision.
10. Responsibility and statutory rights
Each party remains responsible for its conduct and obligations under applicable law. General website information should be assessed in the context of your own requirements; project-specific obligations are set out in the relevant agreement.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or gross negligence where applicable, or removes mandatory rights under the Consumer Protection Act, POPIA or other applicable legislation. These terms do not impose an unlimited indemnity or require you to waive statutory remedies.
11. Governing law and disputes
South African law applies to these website terms, subject to any mandatory protections that apply to you. Please contact us first with a description of a concern so we can seek a practical resolution.
If a matter cannot be resolved, either party may use an available lawful remedy, appropriate regulator or court with jurisdiction. These terms do not prevent access to statutory complaint procedures or require compulsory private arbitration.
12. Changes and interpretation
The date and version on this page identify the current terms. Revised terms apply prospectively to website use or submissions where applicable notice or acceptance requirements have been met. They do not automatically amend a separate signed agreement.
If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law. A delay in enforcing a right does not by itself waive it. Any separate agreement takes precedence for the matters it specifically governs.
